Please read these Terms of Use (“Terms”, “Terms of Use”) carefully before using the tgffitness.com website and the Tgffitness app for iPhone (together, the “Service”) operated by TGFDESIGN LLC, doing business as TGFFitness (“us”, “we”, or “our”).

Your access to and use of the Service is conditioned on your acceptance of and compliance with these Terms. These Terms apply to all visitors, users and others who access or use the Service.

By accessing or using the Service you agree to be bound by these Terms. If you disagree with any part of the terms then you may not access the Service.

Intellectual Property

The Service and its original content, features, and functionality are and will remain the exclusive property of TGFDESIGN LLC and its licensors.

Health and Fitness Disclaimer

Tgffitness is a journal for recording workouts you have chosen to do. It is not a medical device and it does not provide medical advice, diagnosis, treatment, or a training program. Nothing in the app or on this website replaces advice from a qualified healthcare professional.

Consult a physician before starting any exercise program, particularly if you are pregnant, have an existing medical condition, or have been inactive. You exercise at your own risk. Stop and seek medical attention if you feel pain, dizziness, or discomfort. Goals, streaks, and reminders are motivational features, not medical recommendations.

Subscriptions and In-App Purchases

Tgffitness is free to download and includes a free tier that lets you log up to ten workouts. Premium removes that limit and unlocks the Year and Stats views.

Prices are in US dollars and may differ by region. The price shown in the app at the time of purchase applies.

Payment is charged to your Apple Account at confirmation. Auto-renewing subscriptions renew unless cancelled at least 24 hours before the end of the current period, and your account is charged within 24 hours before the period ends. You can manage or cancel a subscription in Settings on your device under your Apple Account. Deleting the app does not cancel a subscription. Lifetime does not renew and can be restored with Restore Purchases in the app.

Refunds for purchases made in the app are handled by Apple under its own policies, not by us. Request one at reportaproblem.apple.com. The “all sales are final” statement in the Digital Products section below applies only to digital products bought on the tgffitness.com website.

Your Content

Workouts, notes, and workout types you create are yours. They are stored on your device and we claim no ownership of them.

Links To Other Web Sites

Our Service may contain links to third-party web sites or services that are not owned or controlled by TGFDESIGN LLC.

We have no control over and assume no responsibility for the content, privacy policies, or practices of any third-party web sites or services. You further acknowledge and agree that we shall not be responsible or liable, directly or indirectly, for any damage or loss caused or alleged to be caused by or in connection with use of or reliance on any such content, goods or services available on or through any such web sites or services.

We strongly advise you to read the terms and conditions and privacy policies of any third-party web sites or services that you visit.

Digital Products and Purchases

All digital products purchased through tgffitness.com are for personal, non-commercial use only. You may not resell, redistribute, share, or claim ownership of any digital product purchased from us. All sales are final as outlined in our Refund Policy. Violation of these terms may result in termination of access to our services.

Termination

We may terminate or suspend access to our Service immediately, without prior notice or liability, for any reason whatsoever, including without limitation if you breach the Terms.

All provisions of the Terms which by their nature should survive termination shall survive termination, including, without limitation, ownership provisions, warranty disclaimers, indemnity and limitations of liability.

Disclaimer

Your use of the Service is at your sole risk. The Service is provided on an “AS IS” and “AS AVAILABLE” basis. The Service is provided without warranties of any kind, whether express or implied, including, but not limited to, implied warranties of merchantability, fitness for a particular purpose, non-infringement or course of performance.

Governing Law

These Terms shall be governed and construed in accordance with the laws of the State of Texas, United States, without regard to its conflict of law provisions.

Our failure to enforce any right or provision of these Terms will not be considered a waiver of those rights. If any provision of these Terms is held to be invalid or unenforceable by a court, the remaining provisions of these Terms will remain in effect. These Terms constitute the entire agreement between us regarding our Service, and supersede and replace any prior agreements we might have between us regarding the Service.

Apple

These Terms are between you and TGFDESIGN LLC only, not with Apple Inc. Apple is not responsible for the Tgffitness app or its content, and has no obligation to provide maintenance or support for it. Apple is not responsible for addressing any claim relating to the app, including product liability, legal compliance, or intellectual property claims. Apple and its subsidiaries are third-party beneficiaries of these Terms and may enforce them against you. You confirm that you are not located in a country subject to a US Government embargo and are not on any US Government list of prohibited or restricted parties.

Changes

We reserve the right, at our sole discretion, to modify or replace these Terms at any time. If a revision is material we will try to provide at least 30 days notice prior to any new terms taking effect. What constitutes a material change will be determined at our sole discretion.

By continuing to access or use our Service after those revisions become effective, you agree to be bound by the revised terms. If you do not agree to the new terms, please stop using the Service.
